Pembohongan Itu Terus Berlanjut

Para Pemilik dan Penghuni Rusun yang Terhormat,
 
Telah lama Saudara menderita, karena manipulasi Hukum Rumah Susun yang dilakukan banyak Pengembang, dibantu beberapa Pejabat terkait di Bidang Rumah Susun, baik yang ada di Kementerian maupun yang berada di Dinas Perumahan DKI Jakarta. 
 
Pasal 74 Undang-undang No. 20 Tahun 2011 ayat 1 secara tegas menyatakan Pemilik wajib MEMBUAT Perhimpunan Pemilik Dan Penghuni Satuan  Rumah Susun (PPPSRS). Ayat 2  menyatakan Anggota PPPSRS adalah Pemilik dan Penghuni yang mempunyai Surat kuasa dari Pemilik. Siapakah yang wajib membentuk PPPSRS? Jawabannya adalah Pemilik.
Siapa Anggota PPPSRS? Jawabannya Pemilik dan Penghuni (Non Pemilik). Pasal ini selalu di-manipulasi, sehingga Developer dapat memberikan Surat Kuasa kepada orang-orangnya untuk masuk kedalam Rapat dan meminta untuk mempunyai hak suara.
 
Sebenarnya,
Hak suara dalam Pembentukan PPPSRS dan Pemilihan Pengurus PPPSRS hanya dimiliki oleh pemilik yang menghuni. Baik hak memilih atau hak dipilih. Sedangkan pemilik yang TIDAK menghuni memberi kuasa Kepada orang yang mengontrak Untuk hadir  Rapat. Akan tetapi dikarenakan mereka bukan Pemilik, maka mereka TIDAK WAJIB ikut membentuk PPPSRS. Juga perlu diketahui bahwa kewajiban adalah bukan hak. Jadi Penghuni Non Pemilik juga TIDAK punya hak Untuk ikut membentuk PPPSRS.
 
Karena Penyelewengan Pasal ini selalu didukung oleh oknum Pemerintah, maka pengembang selalu menang dalam membentuk PPPSRS.
 
Kemudian Penyelewengan Hukum ini dicantumkan dalam AD ART, yang disahkan oleh Pemda DKI selaku Pembina. Jadilah lebih “kuat”.
Pemilik Murni yang Tidak setuju diminta diam atas manipulasi itu. Yang memprotes diancam pidana dengan bantuan oknum polisi nakal.
 
Akibat manipulasi Hukum itu, maka:

  1. PPPSRS selalu dikuasai oleh orang-orang Pengembang yang diberi TUGAS sebagai Pengurus.
  2. PPPSRS berwenang membentuk atau menunjuk Pengelola. PPPSRS menunjuk Pengembang atau Anak Perusahaanya  sebagai Pengelola.
  3. Secara Hukum PPPSRS berhak menentukan Tarif Pengelolaan, menarik uang apapun yang diputuskan dalam rapat dalam rangka pengelolaan Rumah Susun. Karena PPPSRS-nya telah dikuasai Pengembang maka pengembang berkuasa atas apa saja.

Inilah sebenarnya Penyakit dalam Rumah Susun.

Tetapi para Pemilik dan/atau Penghuni yang protes banyak yang mempermasalahkan gejala PENYAKIT-nya tetapi tidak bisa FOKUS Kepada penyakitnya. Celakanya lagi mereka sulit untuk BERSATU dalam perjuangan. Terlalu  gampang diadu domba. Ada juga yang disuap agar memusuhi teman sendiri.
Ada juga yang diumpani informasi yang salah tentang kejelekan teman untuk disebarluaskan. Ada juga yang mau ditokohkan tetapi buat melawan teman sendiri.

Banyak yang Tidak mau belajar undang-undang, sehingga mudah dijebak dalam perundingan.
Banyak yang Tidak bisa Mencium bahaya. Mungkin Karena jiwanya murni (bersih), sulit ber-curiga.

Yang saya maksud gejala ialah akibat yang timbul Seperti,

  1. Tarip IPL yang sering naik.
  2. Sinking fund yang TIDAK jelas rimbanya.
  3. Penghuni yang harus membayar parkir di RUMAH SENDIRI.
  4. Tidak adanya laporan pertanggungjawaban keuangan Kepada para Pemilik.
  5. Mark up harga listrik dan air.
  6. Pengenaan PPN atas barang yg seharusnya TIDAK terkena PPN.
  7. Penyewaan atas barang Milik Bersama dan daerah Milik Bersama, dimana uangnya TIDAK dilaporkan. Contoh kantin, Base Transmision Station, dll.

Marilah kita FOKUS kepada PENYAKIT, jangan hanya sibuk dengan Curhat-curhatan “gejala penyakit”-nya saja.

Singkatnya perjuangan harus FOKUS bukan kepada gejala penyakit tetapi FOKUS pada PENYAKITNYA.

Maju terus ” Kalau kita BERSATU tak dapat dikalahkan”

Bantahan dan Pernyataan Terhadap Informasi yang Disampaikan Ibu Kepala Dinas Perumahan dan Bangunan DKI Jakarta

Bahwa kami, perwakilan warga dari berbagai apartemen yang bergabung dalam DEMO ke Dinas Perumahan dan Gedung DKI Jakarta tanggal 10 Maret 2015 lalu, menyatakan apa yang diinfomasikan ibu Kadis (Ibu Ika Lestari Aji, SE, MM. NIP. 196512151985032003) bersama Mualim Wijoyo (COO PT Prima Buana Internusa (PBI)/PT Agung Podomoro Land ) dan Erwin Kallo adalah TIDAK BENAR.

Bahwa DEMO kami adalah penegasan untuk pelaksanaan UU No. 20 yang dilanggar oleh Pengembang dan di-“BIARKAN” oleh Disperum selaku “Pembina”. Bukan seperti yang diinfomasikan kepada masyarakat pertanggal 26 Maret 2015 melalui Radio Sonora (www.sonora.co.id):

  1. Erwin Kallo menyatakan bahwa staff Pengembang menjadi Pengurus (dengan surat kuasa) mewakili Pengembang selaku pemilik (yang mana melanggar UU No. 20 Pasal 74 bahwa surat kuasa tidak bisa untuk memilih dan dipilih).
  2. Oleh Ibu Kadis DisPerum, seakan mengiyakan (menyetujui) pelanggaran tersebut dengan menyatakan: “sangat setuju dengan ahli properti -Erwin Kallo, bahwa demo dan perselisihan hanya masalah “selisih paham”. Faktanya kami menegaskan Demo bukan selisih paham, tetapi kami demo atas penyelewengan UU No. 20 oleh pengembang, perampas hak warga yang di “biarkan” oleh “Pembina”.
  3. Mualim menyataan: “Kami, melakukan provokasi yang sangat besar”. Yang benar: bahwa Kami membantu pemerintah memperjuangkan amanat UU No. 20 Thn 2011 dan keberatan difitnah dengan kata “memprovokasi”.
  4. Oleh Kadis Perum selaku Pembina, mendiamkan pernyataan tersebut, signal setuju dan mendukung dengan memperjelas bahwa “Kadis punya data pengurus PPRS/P3SRS, dan hanya 18% yg ribut. “ Kami tegaskan: Pelanggaran Undang-undang tidak perlu menunggu 100% warga demo baru ditegakkan!
  5. Data pengurus PPRS/P3SRS yang dimiliki Ibu Kadis dimana adanya Mualim dan Ajit selaku kuasa pengembang yang menjabat pengurus dimana-mana, sbg bukti pelanggaran UU No. 20 Pasal 74 (hak surat kuasa) dan pelanggaran Kepmen tentang pengurus wajib ber domisili/KTP dan KK setempat, tapi ibu Kadis masih “membiarkan” dan seakan IKUT setuju agar warga pejuang UU No. 20 sebaiknya tiarap “agar tidak memprovokasi”.

Kami harapkan Ibu kadis dapat mencabut kembali pernyataan dan mengoreksi selaku Pembina :

“Bahwa PERJUANGAN MENEGAKAN AMANAT UU RI adalah TUGAS KITA BERSAMA, dan perjuangan ini bukan “PROVOKASI”!

Selebaran ala brosur promosi berisikan tuntutan yang diberikan oleh para pengunjuk rasa saat demonstrasi di depan gedung Balai Kota DKI jakarta, Selasa (10/3/2015).

 

JAKARTA, KOMPAS.com – Ada hal menarik dalam unjuk rasa para pemilik, dan penghuni apartemen strata atau rumah susun hak milik (rusunami) yang tergabung dalam Kesatuan Aksi Pemilik dan Penghuni Rumah Susun Indonesia (KAPPRI) di Balai Kota DKI Jakarta, Selasa (10/3/2015) pagi tadi.

Selain melakukan orasi, para pengunjuk rasa juga menyebarkan brosur yang biasa dibagikan pengembang dalam mempromosikan produk propertinya. Hanya, “materi promosi” dalam brosur tersebut justru ungkapan sarkasme atas pelanggaran yang terjadi dalam pengelolaan rusunami.

Isi brosur tersebut, adalah:

Dengan spesifikasi sebagai berikut:
1. Pengurus Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun (P3SRS) adalah Boneka Pengembang dengan pemilihan pengurus dilakukan dengan cara rekayasa negatif;
2. Rekayasa AD/ART yang bertentangan dengan UU No. 20 Tahun 2011 tentang Rumah Susun;
3. Rapat Umum Tahunan (RUTA) selalu direkayasa negatif oleh pengembang yang berganti wajah menjadi pengelola;
4. P3SRS/PPRS tidak mempertanggungjawabkan keuangan sebagaimana ketentuan UU No. 20 Tahun 2011 dan AD/ART dan tidak pernah mau diajak bertemu dan membahas permasalahan Apartemen dengan Penghuni/Pemilik;
5. Merahasiakan status hak atas tanah kawasan Rumah Susun;
6. Penunjukan Langsung Pengelola tanpa tender dengan kontrak borongan (lumpsum);
7. Asset milik bersama dan fasilitas umum tetap dikuasai Pengembang yang kemudian berubah menjadi pengelola dan kemudian digunakan untuk mencari keuntungan secara illegal;
8. Mark up tarif listrik dan penetapan sepihak besaran tarif service charge/Iuran Pengelolaan Lingkungan (IPL), menarik pungutan PPN 10% yang bertentangan dengan hukum;
9. Pembayaran asuransi dibebankan kepada warga/penghuni/pemilik, tanpa tender, pemegang polis atas nama pengembang/pengelola sehingga klaim yang berhak mendapatkan bukan warga melalui P3SRS;
10. Tagihan warga masuk ke rekening pengembang, bukan ke rekening PPPSRS sebagaimana ketentuan AD/ART;
11. Pengelola menggunakan kekerasan/intimidasi dan kriminalisasi kepada pemilik/penghuni yang memprotes kesewenangan dan ketidakjujuran kepengelolaan.
12. Kualitas bangunan yang tidak sesuai dengan yang dijanjikan pada saat penjualan.
13. Merekayasa Perjanjian Pengikatan Jual Beli dengan banyak klausul baku yang panjang lebar, sehingga calon pembeli tidak terkecoh dan terjebak dalam perikatan yang merugikan pembeli;

Sebelumnya diberitakan, puluhan pemilik, dan penghuni rumah rusunami yang tergabung dalam Kesatuan Aksi Pemilik, dan Penghuni Rumah Susun Indonesia (KAPPRI) menggelar aksi unjuk rasa di depan Balai Kota DKI Jakarta.

Aksi tersebut dilakukan untuk menentang berbagai kebijakan pemerintah yang dianggap hanya menguntungkan pengembang. Selain itu, pihak KAPPRI meminta adanya pemilihan ulang Perhimpunan Penghuni dan Pemilik Satuan Rumah Susun (P3SRS) yang diduga dibentuk secara sepihak oleh pengembang.

Berdasarkan pantauan Kompas.com, beberapa pemilik, dan penghuni rusunami yang melakukan unjuk rasa berasal dari apartemen ITC Mangga Dua, Graha Cempaka Mas, Green Pramuka, Kalibata City, dan Marina Ancol.

KAPPRI appreciates that JAKARTA POST has reported the frustration of APARTMENT OWNER/RESIDENTS, however there are few misleading information which we request you to please consider to rectify which are marked in RED and the correct information is in BLUE CAPITAL LETTERS

Residents of a number of strata-title apartment buildings in Jakarta have voiced their concern over the questionable management (THE RIGHT WORD IS FORCEFUL/ILLEGAL MANAGEMENT BY SISTER COMPANY’S OF DEVELOPERS TWO OF WHICH KAPPRI HAS IDENTIFIED ARE PT. PRIMA BUANA INTERNUSA AND PT. DUTA PERTIWI) of their apartment buildings through blogs and social media.
For example, some residents of Kalibata City apartments in South Jakarta have posted their complaints on the jaringkalibatacity.blogspot.com weblog, while dissatisfied residents of The Green Pramuka Apartments in East
Jakarta lashed out on a Twitter account @dgreenpramukaku.

On Tuesday, they took their frustration to the streets.

The residents, grouped under the United Action of Indonesia Apartment Owners and Tenants (KAPPRI), staged a protest in front of City Hall, demanding the city administration settle their disputes with apartment managements. (DISPUTE IS BETWEEN DEVELOPERS AND REAL OWNERS/RESIDENTS OF THE APARTEMENT. THE MANAGEMENT IN ALL THE CASES IS A SISTER COMPANY OF THE DEVELOPER AND HAS OCCUPIED THE MANAGEMENT OFFICE FORCEFUL BY USING FALSE/FORGED DOCUMENTS IN THEIR FAVOUR WHICH IS AGAINST THE LAW UU 20 TH 2011 TTG RUMAH SUSUN)

The group also demanded a proper election of tenants and owners associations (P3SRS), as stipulated by law. Simson, one of the residents, said Law no 20/2011 on apartments stated that management of strata- title apartments should be handed over to the owners and tenants who will later assign a contractor. (THE LAW STIPULATES WITHIN ONE YEAR DEVELOPER MUST HANDOVER THE BUILDING MANAGEMENT/ASSETS TO THE OWNERS AND IS ALL THE CASES REPORTED TO KAPPRI DEVELOPER REFUSES TO ABIDE BY THE LAW. THE REGULATORS OF THE LAW WHICH IS MENPERA, PEMDA DKI JAKARTA, DINAS PERUMAHAN, POLICE, CAMAT, LURAH ARE CLEARLY ON THE SIDE OF THE DEVELOPER AS THEY ONLY WATCH AND REFUSE TO TAKE ANY ACTION AGAINST THE DEVELOPERS WHO DO NOT ABIDE BY THE LAW. THIS ONLY LEADS TO ONE CONLCUSION THAT MOST PROBABLY DEVELOPER HAS FILLED THE POCKETS OF THE PEOPLE INCHARGE IN THE INSTITUES. INFACT ALL CASES THEY HAVE ISSUED STATEMENTS, DOCUMENTS, LETTERS WHICH ONLY MAKE THE DEVELOPER STRONGER AND BREAK/MANIPULATE THE LAWS AT WILL. REAL OWNERS REPORTS ARE COMPLETELY IGNORED. INFACT POLICE REPORTS ARE ALSO NEVER TAKEN SERIOUSLY. BUT IF DEVELOPER REPORTS POLICE WILL HANDLE IS WITHIN MINUTES AND THE OWNER WILL BE IMMEDIATELY A SUSPECT.)

“The reality is around 60 apartment complexes are still controlled by the developers,” he said, as quoted by kompas.com, adding that the city administration was supposed to monitor and control apartment management.

Residents who participated in the protest were from ITC Mangga Dua apartments in West Jakarta, Graha Cempaka Emas in Central Jakarta, Green Pramuka in East Jakarta, Kalibata City in South Jakarta and Marina Ancol in North Jakarta. Issues like unreasonable hikes in maintenance, electricity and water charges as well as the misuse of public and social facilities for commercial purposes (ONCE AGAIN WE HAVE TO REITERATE HIKES IN SERVICE CHARGE ARE ILLEGALLY AND FORCEFULL IMPOSED, ELETRICITY IS USED AS A WEAPON TO INTIMIDATE OWNERS/RESIDENTS IN ACCEPTING SUCH HIKES, ELETRICITY IS ILLEGALLY SOLD AND DISTRUBUTED ILLEGALLY, ref to UU30 Th 2009 ttg KETANAGALISTRIKAN,, FASOS/FASUM IS NEVER HANDEDOVER TO OWNERS/RESIDENTS AND IS ILLEGALLY OCCUPIED BY SISTER COMPANY’S OF DEVELOPERS) usually emerge as issues when apartment residents are unsatisfied with financial reports (FINANCIAL REPORTS ARE NEVER GIVEN TO OWNERS/RESIDENTS AND IF GIVEN ARE ALWAYS MANIPULATED. THE FINANCIAL REPORTS ARE CONTROLLED BY THE DEVELOPERS FROM DAY ONE) or are not involved in the P3SRS.

An example cited was the 18-tower Kalibata City complex. The management of the building, PT Prima Buana Internusa, a subsidiary of the developer Agung Podomoro Group, increased the maintenance costs from Rp 2.3 million (US$174.8) per year in 2014 to Rp 3.29 million per year this year for Kalibata Residence and Kalibata Regency and Rp 4.5 million to Rp 6.1 million for Kalibata Green. ( AS IT HAS BEEN POINTED OUT HERE PT. PRIMA BUANA INTERNUSA HAS HIKED THE CHARGES. INFACT BY LAW THEY ARE WORKING FOR THE OWNERS/RESIDENTS OF KALIBATA. THEY HAVE NO SAY OR RIGHT TO INCREASE THESE CHARGES WITHOUT THE CONSENT OF THE OWNERS/RESIDENTS. WE ASSURE YOU IT IS NOT THE HIKE WHICH IS PINCHING THE OWNERS/RESIDENTS. IT IS THE ONE SIDED ILLEGAL DECISION MAKING WHICH IS FRUSTATING. OWNERS/RESIDENTS ARE GIVEN RIGHTS BY THE UU 20 TH 2011 TO PLAN/REVIEW/DISCUSS/MANAGE THE FUNDS AND  THE BALANCE SHEET OR ANY OTHER IMPORTANT ISSUE IN RUTA(YEARLY PUBLIC MEETING) WHICH IN ALL CASES IS NEVER DISCUSSED. INFACT PT. PRIMA BUANA INTERNUSA AND PT. DUTA PERTIWI CONTROL THE SUCH MEETINGS BY PURPOSELY SETTING THE VENUE FAR AWAY FROM THE APARTMENT COMPLEX. IN SUCH MEETINGS OWNERS/RESIDENTS ARE NEVER INVITED IN MOST CASES. IF INVITED THEY ARE NOT ALLOWED TO ENTER THE PREMISES, IF OWNERS/RESIDENTS MANAGE TO GET IN THEY ARE CORDONED OFF BY THUGS HIRED TO START A FIST FIGHT WITH OWNERS/RESIDENTS. THE MEETING IS JAM PACKED WITH PT. PRIMA BUANA INTERNUSA AND PT. DUTA PERTIWI STAFF)

One of the residents, Umi Hanif, said the management had failed to produce convincing financial reports on the income and expenditure of the maintenance costs when the residents asked for transparency.

Umi, who has been living in Kalibata City since 2011, said the tenants were also not informed about the formation of the P3SRS in Kalibata City. “Without the residents being told anything, we heard the committee members for the [election of the P3SRS] had been inaugurated,” she said.

Umi said the committee could decide the eligible candidates for P3SRS membership. “However, many of the committee members are related to the management or developer,” she said.

Responding to the complaint, general manager of Kalibata City Evan T Walad denied the formation of the committee to hold the election for the P3SRS was unilateral. He said that as a representative of the developer, his company fully supported the formation of the P3SRS and would facilitate it.

Evan said he would also be available to meet residents who were unsatisfied with the committee.

KAPPRI STRONGLY RECOMMENDS ALL INDONESIANS TO NOT BUY OR LIVE IN ANY APARTMENT COMPLEXES AS GOVERNMENT HAS TURNED A BLIND EYE ON IMPLEMENTING UU 20 TH 2011 TTG RUMAH SUSUN.

“The reality is around 60 apartment complexes are still controlled by the developers,” he said, as quoted by kompas.com, adding that the city administration was supposed to monitor and control apartment management.

Residents who participated in the protest were from ITC Mangga Dua apartments in West Jakarta, Graha Cempaka Emas in Central Jakarta, Green Pramuka in East Jakarta, Kalibata City in South Jakarta and Marina Ancol in North Jakarta.

Issues like unreasonable hikes in maintenance, electricity and water charges as well as the misuse of public and social facilities for commercial purposes usually emerge as issues when apartment residents are unsatisfied with financial reports or are not involved in the P3SRS.

An example cited was the 18-tower Kalibata City complex. The management of the building, PT Prima Buana Internusa, a subsidiary of the developer Agung Podomoro Group, increased the maintenance costs from Rp 2.3 million (US$174.8) per year in 2014 to Rp 3.29 million per year this year for Kalibata Residence and Kalibata Regency and Rp 4.5 million to Rp 6.1 million for Kalibata Green.

One of the residents, Umi Hanif, said the management had failed to produce convincing financial reports on the income and expenditure of the maintenance costs when the residents asked for transparency.

Umi, who has been living in Kalibata City since 2011, said the tenants were also not informed about the formation of the P3SRS in Kalibata City. “Without the residents being told anything, we heard the committee members for the [election of the P3SRS] had been inaugurated,” she said.

Umi said the committee could decide the eligible candidates for P3SRS membership. “However, many of the committee members are related to the management or developer,” she said.

Responding to the complaint, general manager of Kalibata City Evan T Walad denied the formation of the committee to hold the election for the P3SRS was unilateral. He said that as a representative of the developer, his company fully supported the formation of the P3SRS and would facilitate it.

Evan said he would also be available to meet residents who were unsatisfied with the committee.

“We will try to accommodate all interests in forming the P3SRS. We have around 13,000 residents, so it will be hard to satisfy everyone,” he said, as quoted by kompas.com.

Sejumlah masyarakat yang tergabung dalam kesatuan Aksi Pemilik & Penghuni Rumah Susun Indonesia (KAPPRI) melakukan unjuk rasa di depan kantor Gubernur DKI Jakarta, dan Kantor dinas perumahan DKI Jakarta, Selasa (10/3).

Mereka menuntut Penegakan Undang-Undang Rusun no.20 th 2011, dan memberikan sangsi kepada developer karena melanggar undang-undang yang ada, serta digantinya seluruh pengurus Perhimpunan Penghuni dan Pemilik Satuan Rumah Susun (P3SRS) yang bukan dari kalangan pemilik dan penghuni rumah rusun.

Menuntut Gubernur DKI Basuki Tjahaja Purnama (Ahok) untuk segera menyelesaikan permasalahan antara KPPRI dengan pihak pengembang/developer, dimana dalam undang-undang rusun dinyatakan jelas bahwa tugas dan kewajiban Pemda sebagai Dewan Pembina P3SRS.
